How Heymate handles your personal data is described in this data policy.
Your personal data is any information that can be used to identify you, including your name, address, gender, e-mail address, etc. Heymate collects, uses and shares personal data in order to administer and operate Heymate's websites, and protects your personal data so that you can feel safe and secure.
Heymate ApS, Vestergade 48H, 8000 Aarhus C, CVR 39 12 20 49 (hereinafter Heymate) is the “data controller” and thus responsible for your personal data.
Privacy policy and terms
If you choose to give Heymate personal data, you consent to the transfer and storage of this data on Heymate's servers. We only keep data that is relevant to the service you use. We may collect and store the following data:
- Information you provide yourself when creating a profile, e.g. name, e-mail address, phone number, address, gender, date of birth, your car(s), the insurance company you use and financial information.
- Pictures, texts and videos that you post on our services yourself.
- Statistics on page views, traffic to and from Heymate, advertising data and standard web log information such as IP address, MAC address, device (e.g. mobile), browser type and geolocation.
- Information about how you use Heymate's websites and services, including your transactions;
For the Tjekbil service, the following may also be recorded:
- Information about licence plate and VIN lookups, pictures submitted for licence plate recognition, and information collected from third parties about licence plate and VIN lookups.
You also consent to Heymate sharing your personal data with group companies or service providers that support Heymate's business activities.
Handyhand keeps a list of businesses offering services in the relevant categories. Information about the company or legal persons associated with it is processed on the basis of legitimate interest, and the information is deleted within twelve months after the legal person or the company has ceased to exist.
Purpose and use of the data
Heymate uses the data to:
- Provide our services;
- Find and solve problems with Heymate's websites and services;
- Tailor your user experience, measure interest in Heymate's services, improve Heymate's services and inform you about services and updates;
- Tailor and inform you about marketing and promotional offers according to your preferences.
Protection of data
Heymate does not sell or disclose your personal data to third parties for their marketing purposes without your express consent.
Disclosure to group companies or service providers that support Heymate's business activities is exempt.
Heymate may disclose personal data to comply with legal requirements, enforce Heymate's policies, or protect the rights, property and safety of others.
Heymate may disclose personal data to respond to claims that an advertisement or other content infringes the rights of others, or in connection with criminal cases. Requests for information of this kind must be made in writing to Heymate at the following e-mail address: support@heymate.dk.
The data is only handed over on request from public authorities such as the police, the courts or the Danish Data Protection Agency.
Marketing, communication and e-mail tools
You may receive marketing material from Heymate and our associated companies, including Heymate and strategic partners such as finance and insurance companies. If you do not wish to receive marketing material from Heymate, you can contact support at the following e-mail address: support@heymate.dk.
Heymate may use the information it has about you and your activities on Heymate's websites to tailor the messages Heymate sends you, as well as the content and advertising Heymate shows on its websites.
Cookies
On some of Heymate's websites, Heymate or our suppliers use cookies (small files placed on your hard disk). Heymate does not allow our suppliers to collect personal data about you through these cookies. The cookies are used to analyse visits to Heymate's websites, tailor Heymate's services, content and advertising, measure promotional activities, and promote trust and safety.

Security
Heymate treats data as assets that must be protected, and uses tools (encryption, passwords, physical security, etc.) to protect your personal data against unauthorised access and disclosure.
However, Heymate does not guarantee that third parties will not unlawfully intercept or otherwise gain access to transmissions or private messages, or that third parties, including other users, will not misuse personal data about you that they lawfully collect from the website.
Supervisory authority
In Denmark, the processing of personal data is supervised by the Danish Data Protection Agency (Datatilsynet), which can be contacted at Borgergade 28, 1300 Copenhagen K, or at dt@datatilsynet.dk.
Your rights and objecting to the use of your data
Within the limits of the law, you have certain rights, including:
- The right to access your personal data
- The right to have incorrect personal data corrected
- The right to have personal data deleted
- The right to have the processing of personal data restricted
- The right to data portability
- The right to object to the processing of personal data, including automated individual decision-making

Content on Heymate's websites and apps
By using Heymate, you agree not to copy, modify or redistribute Heymate's services (websites and mobile applications) or their content, including content posted by other users. You also undertake not to infringe the copyrights, trademark rights or other intellectual property rights of Heymate or third parties.
By creating content, including pictures, text, etc., on Heymate's services, you warrant that you hold the full rights, including all intellectual property rights, to this content, and that the content does not violate the law or the rights of third parties.
By creating content, including submitting pictures, text, etc. on Heymate's services, you give Heymate permission to show your content on all of Heymate's websites and mobile applications, and on Heymate's other internet-based services, such as Heymate's Twitter and Facebook profiles. Pictures created on Heymate's websites may automatically get Heymate's logo as a watermark. Please also note that content on the internet – and on Heymate – can be shared by other users to their own social profiles, e.g. on Facebook.
Heymate also uses the Google Maps API in most services.
Rights holders
If content on Heymate's websites infringes the intellectual property rights of others, the rights holder can contact Support at support@heymate.dk and ask for the content to be removed or changed. Heymate reserves the right to change and/or delete the content at its sole discretion.
Heymate's liability
As a user of Heymate's websites, you agree to hold Heymate harmless from any liability in connection with your actions on Heymate's websites. Heymate obtains information from a wide range of services, including (but not limited to) the Danish Motor Register, the Land Registry and the Danish Road Traffic Authority. For the same reason, Heymate cannot be held liable for any loss, damage or infringement arising from content on its websites.
Heymate does not guarantee access to Heymate's services or websites, nor the security of this access or that it will be continuous. For the same reason, to the extent permitted by law, Heymate disclaims any liability for loss or damage that may arise in this connection.
To the extent permitted by law, Heymate expressly disclaims all warranties and representations, express, implied or statutory, for the content of Heymate's websites and the services Heymate provides.
To the extent permitted by law, Heymate disclaims any direct or indirect liability for loss or damage, including loss of money, data, goodwill, reputation, etc., that may arise from using Heymate or the services made available on Heymate's websites.
Force majeure
Notwithstanding the above, Heymate is in particular not liable for losses caused by: breakdowns of and/or failing access to IT systems, or destruction of or damage to data in these systems, attributable to the events listed below, even if Heymate operates the systems: failure of power supply or telecommunications at Heymate, legislative intervention, terrorism or vandalism (including computer viruses and hacking), unrest, riots, sabotage, war, natural disasters, unexpected price increases, strikes, lockouts, boycotts or blockades, whether the conflict is directed at or initiated by Heymate itself or its organisation, and whatever the cause and extent of the conflict.
Limitation of liability
If Heymate is found liable despite the preceding sections, Heymate's liability both in and outside contract (whether arising from negligence or otherwise) is limited to the greater of (a) the total payments to Heymate in the 12 months before the matter giving rise to liability, or (b) DKK 1,000.
This limitation of liability does not apply to consumers.
Personal data
As a user of Heymate's websites, you agree that Heymate (the data controller) collects, transfers, stores and uses your personal data on servers located in Denmark or elsewhere in the world, as described in more detail in the data policy. You are responsible for keeping your personal data accurate and for protecting your password. If you suspect that your password has been misused, you should contact support at support@heymate.dk immediately to have it changed.
General
These terms and any related terms given for specific services make up the entire agreement between Heymate and you and replace all previous agreements. This agreement is governed by Danish law and subject to the jurisdiction of the Danish courts. If one or more conditions are invalid, the terms as a whole remain in force.
Changes or corrections
Heymate may change or correct these terms in writing at any time. The changes or corrections take effect at the earlier of: (a) the next time you add or change content on Heymate's websites, or (b) 30 days after the terms were changed.
If the terms change significantly, you will be notified by e-mail.

Specifically for Bilgalleri, Hestegalleri and Scootergalleri
PRICE AND PAYMENT:
Heymate charges for certain services.
If Heymate charges for a service, you will be shown the price in Danish kroner (DKK), including VAT, for review and acceptance before you pay. When paying by credit card, Dankort or otherwise, a fee will be added to your payment, which you will be told about before you pay. Heymate also offers subscriptions with automatic recurring payment.
Heymate's prices may change at any time.
If your Heymate user account is closed or frozen because of a breach of our terms of use, payments already made for services are not refunded to the extent the service has been delivered or performed.

No right of withdrawal for services
When you buy services, including services bought by mobile phone, Heymate starts providing the service immediately after the purchase, and your 14-day right of withdrawal ends from the moment the service is made available to you.
You accept that the service starts before the 14-day withdrawal period ends, and that you cannot withdraw from the agreement once it has started.
VIP subscription
On BilGalleri you can buy a VIP subscription. The subscription is ongoing and renews every 30 days.
The subscription gives access to the following benefits.
- Creating listings in the marketplace
- Uploading pictures in the forum
- VIP icon on your user profile
- You can cancel your VIP subscription under “Min konto” – “VIP-abonnement” by clicking “slet abonnement”.
Note: the subscription is only cancelled once you have received a confirmation by e-mail. - If you paid by text message, you can also cancel by sending “BG STOP” to 1231.

- When you cancel your subscription, it runs until the end of the period and then stops.
